And with a t'ed vent return, (no selector valve) the return fuel will return
to the tank that has the least flow resistance, not necessarily the emptiest
tank.

What did you have in mind here Bob? I cannot think of a scenario
where the fuller tank had less flow resistance than the emptier tank
except perhaps in a slip or with a clogged vent situation.
It is mostly a matter of pressure head.
