He complied with the law as the FAA would not call this a major mod
and would not want to re certify something this trivial.
The law says that you can make mods and sign them off yourself in
this experimental world, can you imagine calling the FAA every time
we change oil coolers, radiators and other stuff that we do.
Also the FAA laws have changed since this old 1998 case and I have
heard that this case was part of what caused those changes.

This is true but will only take effect for your aircraft if you convert
your Operation Limitations to the new style. The local FSDO will help
you with this. In other words: although the law changed, with the old
style Operation Limitations of your aircraft you are bound to comply
with them and run major alternations by the FAA.
