They could have. There are several patents out on variable twist
blades. I notice IVO does not claim to have a patent on his.

Getting a patent is not the problem. Defending a patent is the problem.
That is why I no longer bother. I have a patent. Not worth the paper it
is written on even though Hewlett Packard manufactured it. I sued and "won".
The real winners were the lawyers. Am I going to sue Boeing successfully?
I don't think so.
